The Inheritance Entitlement of Apostate Heirs According to Islamic Legal Provisions
Main Article Content
Abstract
According to Islamic law, inheritance is the transfer of rights and obligations from the testator to their legal heirs. In Indonesia, the inheritance system is governed by three legal systems: Islamic, civil, and customary. A crucial issue is apostate heirs, who, according to the Compilation of Islamic Law (KHI), are not entitled to inherit. This creates a conflict between religious values and social justice. This paper discusses the legal and social implications of apostate status in inheritance and the urgency of resolving disputes fairly based on the principles of sharia and applicable law.
